Texas Line Contractor Payroll and Employer Control Checklist

A payroll provider can process transactions, but the business still needs a source-linked owner record for worker classification, onboarding, Texas unemployment tax, federal employment taxes, filing evidence and exceptions.

Boundary: this page does not classify a worker, calculate tax, choose a return or replace TWC, IRS, CPA or legal review. Keep Social Security numbers, tax records and employee data out of shared worksheets. This site does not issue licenses, submit applications or guarantee work.

Employer responsibility matrix

Control Question Official source Internal owner Provider role Evidence Status
Worker classification What facts show direction, control and the real working relationship? TWC classification guidance Owner with qualified adviser Provide records, not the final assumption Dated fact matrix and reviewer decision Confirmed or unresolved
New-hire reporting Was the required Texas report made for the actual hire? TWC new-hire page Onboarding owner Prepare or transmit only under written scope Submission receipt without shared private data Due, submitted or exception
TWC unemployment tax Is the employer account, wage report and payment workflow current for this entity? TWC employer guidance and account record Texas payroll-tax owner Process the assigned step Account notice, report receipt and reconciliation Due, filed, paid or unresolved
Federal payroll setup Which withholding, deposit and return categories apply? IRS employment-tax guidance Federal payroll-tax owner Calculate or transmit under approved instructions Approved setup and current filing calendar Confirmed or unresolved
Payroll run Do approved hours, pay terms, deductions and additions match the provider preview? Company record and qualified review Payroll approver Create the preview Expected versus observed reconciliation Approved, exception or blocked
Returns and deposits Do official receipts match the approved payroll and liability records? TWC and IRS accounts Named tax owner Transmit if authorized Return, deposit and account confirmations Matched or exception
Year-end and correction Are wage statements, corrections and account totals reconciled? Current official instructions Year-end owner Prepare reports under written scope Control totals and exception log Matched or unresolved

TWC says the worker’s label alone does not decide classification. Its employer guide also warns that a payrolling arrangement does not by itself move unemployment-tax responsibility away from the business receiving the work. Keep the provider’s task and the employer’s decision owner separate.

Minimum onboarding and payroll handoff

  1. Document the real work relationship and send unclear classification facts to a qualified adviser before setup.
  2. Assign an owner for Texas new-hire reporting. TWC’s current page says the report is due within 20 days of the first day on the job; confirm the current rule at the source for every case.
  3. Confirm the correct TWC employer account and current wage-reporting workflow for the employing entity.
  4. Have a CPA or qualified payroll-tax professional map the applicable IRS withholding, deposit and return categories.
  5. Before each payroll is released, compare approved source records with the provider preview. After filing or payment, compare official receipts with the approved control totals.
  6. Keep each mismatch open with an owner, source and next review date. Never use a missing receipt as proof of completion.

Questions for the CPA, payroll adviser or employment lawyer

  • Which entity is the employer for this worker and why?
  • Which TWC account, report and current due date apply?
  • Which IRS return and deposit schedule applies to this business?
  • Which actions will the provider perform, and which approvals stay with the employer?
  • Which records can be shared, who may access them and where are private identifiers stored?
  • How will corrections be approved, transmitted and reconciled?
