Short answer: Keep employment terms, wage records, side-work records, tool responsibility, benefits, injury contacts, scope, changes, and insurance questions in separate evidence fields. A job title or payment label alone does not settle worker classification, tax treatment, contract authority, or insurance coverage.
This guide is an educational checklist. It does not provide legal, tax, or insurance advice. This site does not issue a license, file an application, make a worker-status decision, or guarantee employment.
Keep employee wage and tax support records in one lane
The IRS says Form W-2 reports wages from employers, while Form 1099-NEC is used for freelance and independent-contractor income. The IRS also tells taxpayers to gather the documents and tax forms needed for an accurate return. Keep the actual records in your secure tax or payroll file, not in a career-tree exercise.
| Record lane | Keep together | Do not infer |
|---|---|---|
| Employee wages | W-2, pay statements, withholding records, filed-return support, and correction correspondence | Do not relabel employee wages as self-employment because a shift is temporary or part time. |
| Side work or self-employment | Payment records, invoices, expense support, estimated-payment records, and the payer form received | Do not assume every payment is nonemployee income without checking the actual relationship. |
| Classification unresolved | Written description of who directs the work, who supplies key resources, and which IRS or professional review is pending | Do not choose the classification that appears easier. |
Completion evidence: a private index showing where each record is stored, the period it covers, and whether any correction or classification question remains open. Do not upload a W-2, pay statement, tax return, account number, or personal identifier to the learning system.
Build a written job-terms and injury-contact file
The Texas Workforce Commission employer guide recommends clear written pay terms and says benefit specifics should be clear and in writing. Its workers’ compensation page also identifies coverage notices and the work-injury reporting path as items workers need to understand. Use those sources as questions for the employer, not as a substitute for the employer’s current documents.
| Field | Evidence to preserve | Question if missing |
|---|---|---|
| Role and assignment | Written title, work location, reporting contact, expected start, and stated duties | Which duties and locations are included in the offer? |
| Pay and schedule | Pay period, expected shift, overtime or on-call expectation, and any stated review point | Which schedule and pay terms are current? |
| Tools and equipment | Employer or program list showing who supplies, maintains, replaces, or approves each category | Which items are mine, company supplied, or restricted? |
| Benefits | Eligibility document, enrollment contact, start condition, and plan reference | Where are the current terms written? |
| Work injury | Coverage or noncoverage notice, immediate reporting contact, clinic or response instruction, and form location | Who must be contacted first and where is the current process? |
Completion evidence: one dated index with a pointer to each employer document. Keep medical, payroll, and identity details in the responsible employer system.
Separate full-time, part-time, and side-work income records
Hours or schedule labels do not replace the worker-status review. Use the form received, the actual working relationship, and current IRS guidance. The IRS says classification turns on the whole relationship and the right to direct and control the work. It also says self-employment income may create an estimated-tax question.
| Income situation | Record set | Review question |
|---|---|---|
| Employee job, any schedule | W-2, pay statements, withholding, benefits records, and return support | Is the payer treating this as employee wages, and do the records agree? |
| Side work treated as self-employment | Income received, payer forms, invoices, business expenses, mileage where relevant, and estimated-payment records | What belongs on the return, and does estimated tax apply to this situation? |
| Status unclear | Contract, instructions, control facts, payment records, and the unanswered question | Should the worker, business, IRS, CPA, or attorney review the classification? |
Ask a CPA about your facts before acting. Use IRS Form SS-8 information when a formal federal worker-status determination is being considered. Do not put personal tax records into a member exercise.
Confirm scope, changes, responsibility, and insurance before accepting a task
TDLR treats electrical contracting as a licensed business activity. Its Electrical Contractor application page requires a Master Electrician of record and proof of liability insurance. A worker title alone does not answer who is contracting, who approves a change, or which policy responds to a specific event.
| Gate | Written evidence | Ask before accepting |
|---|---|---|
| Contracting party | Named customer, licensed business, responsible contact, and current official record | Who is offering the work and under which business authority? |
| Scope and exclusions | Task, location, deliverable, assumptions, exclusions, and stop conditions | What is included, excluded, and still unresolved? |
| Change control | Who may request, price, approve, and release a change | Does work pause until written approval? |
| Responsibility | Permit, inspection, supervision, purchasing, documentation, and customer-contact owners | Who owns each decision and record? |
| Insurance boundary | Policy or certificate pointer, named business, period, broker contact, and unanswered coverage question | What does the broker say about this exact scope and party? |
Send unresolved contract questions to a Texas attorney, tax questions to a CPA, and coverage questions to the insurance broker. Do not calculate a legal deadline, promise coverage, or start work from this checklist.
